ELEKTA'S OPPONENT IN U.S. PATENT DISPUTE DENIED RECONSIDERATION
On Thursday October 30, 2003, the United States Court of Appeals for the
Federal Circuit announced its decision to deny the petition from Medical
Instrumentation and Diagnostics Corporation (Midco), Elekta's opponent
in the U.S. patent dispute, to reconsider its ruling issued on September
22, 2003.
As a result the ruling by the court, which among other findings
determined that none of Elekta's products infringed the Midco patents
and in which Elekta was freed from all liability, remains valid.
Midco may file a petition for review (certiorari) with the United States
Supreme Court. Grant of this remedy is very unusual.
