ELEKTA RECEIVES NOTIFICATION THAT THE U.S. SUPREME COURT DENIES
OPPONENT'S PETITION IN PATENT DISPUTE
As previously announced, Medical Instrumentation and Diagnostics
Corporation (Midco), Elekta's opponent in the U.S. patent dispute, in
January filed a petition for a writ of certiorari with the United States
Supreme Court. The petition requested the Supreme Court to review of the
Federal Circuit's judgment vacating the prior judgment of the District
Court in this case and absolving Elekta of all liability.
On March 29, the United States Supreme Court issued its decision denying
MIDCO's petition for a writ of certiorari.
Following the Federal Circuit's judgment in favor of Elekta, MIDCO has
recently also filed a motion to amend its complaint in the District
Court and requested that it be allowed to amend its case to be based on
different claims of the patents in question. Elekta has opposed MIDCO's
motion. Elekta believes that it is unlikely that MIDCO could prevail
under any of the claims of the patents.
