US DISTRICT COURT DECLARES CASE CLOSED IN ELEKTA PATENT CASE
As previously announced, following the Federal Circuit's judgment absolving Elekta of all liability in the U.S. patent dispute, Elekta's opponent, Medical Instrumentation and Diagnostics Corporation (Midco), filed a motion to amend its complaint in the District Court and requested that it be allowed to renew its case based on different claims of the patents in question.
On June 15, 2004, the District Court denied Midco's motion and terminated the case.
While it is possible for Midco to file an appeal of this decision and Midco has threatened to file a further suit, Elekta believes that it is unlikely that MIDCO could prevail under any of the claims of the patents.
