ELEKTAS OPPONENT IN U.S.PATENT DISPUTE DENIED RECONSIDERATION
On Thursday October 30, 2003, theUnited States Court of Appeals for the Federal Circuit announcedits decision to deny the petition from Medical Instrumentationand Diagnostics Corporation (Midco), Elektas opponent inthe U.S. patent dispute, to reconsider its ruling issued onSeptember 22, 2003.
As a result the ruling by thecourt, which among other findings determined that none of Elektasproducts infringed the Midco patents and in which Elekta wasfreed from all liability, remains valid.
Midco may file a petition forreview (certiorari) with the United States Supreme Court. Grantof this remedy is very unusual.
